Terms & Conditions
1. General
These terms and conditions govern the provision of plastering services (dry lining , plastering, rendering, micro cement /specialised finishes, training courses) provided by H R Bespoke Plastering LTD. ( hereafter referred to as ‘the company’) to you , the client. By accepting our quotation, you agree to be bound by these Terms and Conditions.
2. Quotations
2.1 Quotations/ estimates provided by the company are based on the visual inspection and the information provided by the client at the time of the quote. The quoted price is valid for a period of 30 days from the date of issue.
2.2. The quotation covers only the work detailed in the quote. Any additional work requested by the client or necessary due to unforeseen circumstances will be subject to additional charges.
2.3 If upon commencement of the work conditions are discovered which were not apparent during the initial inspection (eg structural deficiencies, damp or hidden obstacles) the company reserves the right to revise the quote and time frame accordingly.
3. Scope of work
3.1 The scope of work will be clearly outlined in the quotation/estimate provided to the client. Any modifications in the scope must be agreed upon in writing and may be subject to additional charges.
3.2 The company will carry out its work in accordance with industry standards and regulations.
3.3 Any variation or additional work required that was not included in the original agreement will
be discussed with the client and may result in additional charges. All variations must be agreed upon in writing before commencement.
4. Substrate and pre-existing conditions
4.1 Substrate Condition – While every effort is made to ensure that the substrate remains intact during the removal of render or plaster, The company cannot be held responsible for any damage to the substrate that occurs as a result of the ‘hacking-off’ process. Any necessary repairs to the substrate will be the responsibility of the client.
4.2 The company is not responsible for defects resulting from poor condition of the substrate unless specifically asked to repair the substrate as part of the project scope.
4.3 The company will not be liable for the failure of any plaster or render system due to issues with the substrate , existing structural issues or other pre-existing conditions not disclosed at time of the quotation/estimate.
5. Material selection
5.1 The company uses high-quality materials appropriate for each project. However, the choice of materials will be discussed and agreed upon with the client prior to commencement. Any changes to the agreed materials or specifications may result in additional charges.
6. Site Access and Preparation
6.1 The client must ensure that the work area is accessible and adequately prepared for the commencement of work. This includes clearing the area of any obstructions and ensuring safe access for our team. Any delays or additional costs incurred due to site access issues or inadequate preparation will be the responsibility of the client.
7. Completion Dates
7.1 The company will endeavour to meet any agreed upon completion dates but this is not guaranteed. External factors, for example, meteorological issues (rain, strong winds and temperature ,too hot/cold,) impact on application of our products and have to be taken into consideration. We can also not be held liable for material shortages or any other unforeseen factors may impact on completion dates.
8. Payment
8.1 Payment terms will be outlined in the individual contract or quote unless otherwise agreed .
8.2 A 25% deposit will be required when accepting quote and start day agreed .
8.3 In the case of rendering services a 25% deposit will be required for materials. A further 50% of payment after the base coat has been applied and then the final 25% after the silicone coat has been applied/completion.
8.4 Payment in full is due 7 days from final invoice/completion.
8.4 The company reserves the right to cease work if payments are not received by the agreed time.
9 Liability and Insurance
9.1 The company holds public liability insurance for the duration of the work. However, our liability is limited to the value of the contracted work and does not extend to consequential losses, including but not limited to loss of earnings, profits, or goodwill.
10 Warranty
10.1 The company warrants that the work will be carried out to a professional standard and in compliance with all relevant regulations.
10.2 We offer a standard warranty on our workmanship for a period of 12 months from the date of completion. This warranty does not cover damage caused by external factors, such as weather conditions or client misuse, or any materials supplied by the client.
11 Termination/cancellation
11.1 Should the client wish to cancel the contract notice must be given in writing at least 7 days before the scheduled start date. If notice is not given within this time frame a cancellation fee may be charged.
11.2 Either party may terminate the agreement in writing, subject to the terms outlined in the contract. The client will be liable for any work completed up to the date of termination, including any materials ordered or used.
12 Dispute Resolution
12.1 Any disputes arising from or in connection with theses Terms and Conditions shall be resolved through negotiation between the parties. If a resolution can not be reached disputes shall be settled through mediation or arbitration.
13. Microcement Applications
13.1 The company advises that samples provided are indicative only. Due to the handcrafted nature of micro cement applications, variations in texture, colour, and finish may occur when applied across larger surface areas. These variations are inherent to the material and application process and should not be construed as defects.
13.2 By approving the sample, the client acknowledges and accepts that the final finish may differ from the sample due to factors including, but not limited to, lighting, substrate condition, and hand-applied techniques.
13.3 The company will endeavour to achieve a finish consistent with the approved sample, but no guarantees can be made regarding an exact match.
13.4 Any concerns regarding the finished product must be raised within 7 days of completion, after which the company shall have no further liability regarding the aesthetic appearance of the micro cement application.
By engaging HR Bespoke Plastering Ltd, the client acknowledges and agrees to these terms and conditions.
